If you’re being abused at work, you’ve probably heard it: “Just quit.”
As if it’s that simple. But for most people, quitting isn’t easy or even smart.
📌 You have bills. You may have kids. You may be scared.
📌 You may be sick or burnt out, but not sure how to take time off.
📌 You may not realize that quitting can mean giving up your legal rights.
Walking out without a plan can cost you, big time.
🚧 Why Quitting May Not Be the Answer, Yet:
⚠️ It can jeopardize your legal claims. You may lose the chance to pursue wrongful termination or retaliation claims if you walk away too soon.
💸 You might forfeit benefits. Think unused PTO, severance, unemployment insurance, or even COBRA coverage.
👩⚖️ Most lawyers, including me, are reluctant to take on cases where someone just quit, because it makes legal claims harder to pursue. That’s why I *always* urge:
👉 Consult a lawyer first. Make a strategic plan. I call it Escape Planning.
🧠 Your health may not allow for a job search right now. If your body and mind are fried, you need to recover, not just jump into another workplace that could be equally harmful.
✅ What to Do Instead
Here are some safer, more strategic options:
✔️ Call in sick.
You don’t need a doctor’s note for a day or two. Give yourself breathing room now.
✔️ Use your PTO or vacation time.
If your state doesn’t require your employer to cash out unused time when you quit (like in CA), you may as well use it to rest.
✔️ Explore Short-Term Disability.
Many employers offer insurance that pays 60–100% of your salary if you’re under a doctor’s care. Some states, like California, have their own disability plans that can supplement or replace employer benefits.
I help my clients navigate these options all the time.
Most people don’t realize they may be entitled to paid time off and a safe, strategic exit, without walking away empty-handed.
The bottom line?
Do not walk out without a plan. Do not assume you’re out of options. Do not give up your rights to prove a point.
